Jan. 13th, 2004 09:07 pmSo, I was just playing with some dates and numbers from the US Immigration web site.
Once I enter on the K3, I have two choices to get my green card. The first is to wait for the 1-130 petition that Ross filed to go through the Texas Service Center, and go back to Montreal for an interview.
The second is to file to adjust status (Aos). In that case, I have to wait for that petition to finish sitting on a shelf, and then go to an interview in Tampa.
Currently, Tampa is processing AoS cases filed on or before January 30, 2001. That means they're taking about 36 months.
The TSC is processing 1-130's filed on or before July 11, 2001, for about 30 months.
Our 1-130 was filed in July of 2003. Should we opt to do an AoS, it will probably be in March or April.
Thus, waiting for the 1-130 would have it being processed around December of 2005, with an interview in Montreal a couple of months later. Filing AoS would give us an interview date of March 2007.
My K-3 visa will be valid for two years, at which point I have to renew it if I haven't applied for Aos or gone through the Montreal I-130.
Of course, either Tampa or the TSC could speed up or slow down at any time. So while right now, waiting for the I-130 seems the wisest course of action, that could change at any time. So all I really know is that the next few years of my life, I'm going to be paying lots of attention to what's happening at both Tampa and the TSC.
On the upside, I'm almost certainly going to be married for more than two years by the time I get an interview with anyone, so I won't have to deal with a conditional green card.
